A trademark assignment agreement is a document that formally sets down the transfer of ownership of a trademark or service mark from its current owner (assignor) to a new owner (assignee). It’s one of several legal documents that go through the United States Patent and Trademark Office.
A trademark assignment refers to transferring ownership of a trademark registration from one party to another. A trademark license or license agreement is a legal document that gives a third party a few restricted rights to use a given trademark. The original owner retains full rights.
If the USPTO hasn’t recorded the assignment, you can contact their Assignment Recordation Branch and possibly suspend the recordation. You’ll have two days to submit a written letter requesting cancellation.
If the USPTO has recorded the assignment, it can’t be canceled. You must follow the steps outlined in the USPTO’s Trademark Manual of Examining Procedure Section 503.06.
